WGXA broke the story Wednesday evening of an alleged sexual assault at the Dove Center of the Macon Rescue Mission.
A 22-year-old attendee of the mission's GED class says this man, 19-year-old Javorian Quintarius Sims, asked her to perform a sex act on him. When she refused, he then allegedly grabbed her, bent her over and simulated a different sex act telling her, "it's straight, I got a rubber."
Sims turned himself in to authorities Thursday. He's charged with Sexual Assault and Simple Battery.
But some are questioning why the accused is charged with sexual assault.
Attorney Ron Daniels explains to WGXA.
"Assault is when you threaten to touch someone. There's a very limited sexual assault statute for when someone is in a position of power over another, but even then that requires a sexual contact. I guess what should be considered is that a lot of times charges develop and change and evolve over time as cases go on."-Ron Daniels/Burke Lasseter LLC
This case is causing changes to the GED class program at Macon's Rescue Mission. The classes were open to residents and the general public. The victim was a resident; the suspect was not.
"We discussed it and what we're gonna do is suspend the GED classes here temporarily and then when they come back online which I fully want to help the men and women of the mission get their GED we will restrict it to just the men and the women " -Jeff Nicklas/MRM Executive Director
Nicklas says he's not sure when the classes will return but he stands by the policy that they will only be available to mission residents.
