Judge Rules No Probable Cause in East Dublin Police Shooting

In an effort to obtain an arrest warrant for the East Dublin Police Officer that shot and killed her brother, Tonya Daniels applied for an affidavit to incarcerate officer Jeffery Deal.
Special Agent Jerry Jones of the GBI testified that on may 14, 2010 Officer Deal was pursuing a vehicle that ran a stop sign and says deal noticed the vehicle trying to elude him. During testimony Jones says Deal recognized the car and driver to be Melvin Williams a convicted felon and suspect in a firearm theft.
The purpose of the hearing was to determine if Deal acted lawfully when dealing with what happened after both cars came to a complete stop.
Two witnesses' recorded testimonies revealed that the aggressor seemed to be Williams who did not retreat at any point of the altercation.
During the altercation, Jones says Deal was protecting his firearm which Mr. Williams was trying to obtain and almost did. The tape shows Williams giving Deal one last blow before Deal moved back and according to his testimony drew his firearm, and shot Williams.
The judge ruled that there was no probable cause for an arrest on Jeffery Deal. based on the evidence provided, the Judge said it was clear that Mr. Williams continued to re-advance on the officer even after a weapon was being pointed at him.
Judge Donald Gillis says the case can still be presented to a grand jury even though there is no probable case to arrest Deal.

Watching the video is real time makes it hard to know what exactly happened but listening to in depth detail of audio AND watching slow frame by frame of the video it is VERY clear that Deal was doing what he had to do to stay alive!
